Terms of Service & Liability Waiver

Please read these Terms of Service ("Terms") and the Release of Liability ("Waiver") carefully before participating in any match organized through Unseeded (the "Platform"). The Platform is operated by Unseeded ("we," "us," or "our"), a registered business name in the Province of Ontario.

By creating an account, paying for a season pass, or participating in matches, you explicitly agree to these Terms and the Waiver.

Important

The services provided by this Platform are available only to individuals who are at least 18 years of age. By registering, you confirm that you are at least 18 years old. Minors are strictly prohibited from participating.

1. Role of the Platform

Unseeded serves strictly as a facilitator and match-making service. We provide a platform for tennis players to find opponents, track scores, and view leaderboards.

We do not own, manage, maintain, or operate any tennis courts or facilities.
We do not supervise matches or provide umpires, medical staff, or on-site organizers.
Players are solely responsible for choosing, inspecting, and ensuring the safety of the court or terrain they play on.

2. League Rules & Match Play

Players must adhere to the rules of the league as communicated via the Platform and emails. This includes match formats (e.g., Best of 3 Sets, Short Deuce, Super Tiebreak) and reporting scores accurately.

3. Code of Conduct

We enforce a strict code of conduct to ensure a safe and enjoyable environment for all players.

Players must treat opponents, spectators, and public facility staff with respect.
Aggressive behavior, physical altercations, severe unsportsmanlike conduct, or harassment will result in immediate disqualification and a permanent ban from the Platform without refund.

4. Refund Policy

All sales are final once a season has officially begun. No refunds will be issued for any reason, including injury, scheduling conflicts, or disqualification due to a breach of the Code of Conduct, after the start of the season.

5. Waiver and Release of Liability

ASSUMPTION OF RISK AND RELEASE OF LIABILITY

I acknowledge that tennis is a physical sport that carries inherent risks, including but not limited to the risk of severe physical injury, sprains, fractures, heat exhaustion, sudden illness, or death. I also acknowledge that public or private tennis courts may present unforeseen hazards, including uneven surfaces, debris, or slippery conditions.

By registering and participating:

I voluntarily assume all risks, known or unknown, associated with my participation in matches organized via Unseeded.
I accept full responsibility for inspecting any court or facility prior to play and choose to play entirely at my own risk.
I hereby release, waive, discharge, and covenant not to sue Unseeded, its founder, operators, sponsors, agents, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, while participating in such activity, whether caused by the ordinary negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorneys' fees, that they may incur due to my participation in this league, whether caused by negligence of the Released Parties or otherwise.

THIS IS A LEGALLY BINDING DOCUMENT. I UNDERSTAND THAT BY TICKING THE CONSENT BOX DURING REGISTRATION, I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS.
